HOUSTON – The Kim Law Firm represents a University of Texas Health Science Center professor in an ongoing case that may reach the U. S. Supreme Court. The nation’s highest court is being asked to clarify whether state universities and other political subdivisions can be found liable under the False Claims Act. In the petition for writ of certiorari, former University of Texas Health Science Center professor Dr. Terri King is challenging an opinion issued by the U.S. 5th Circuit Court of Appeals that the Houston-based research facility is an “arm of the state” that is exempt from FCA claims.

In her petition, Dr. King contends that the research center is not an arm of the state due to its established autonomy, its $1 billion in independent assets, and its focus on local issues of public health.
